JNU case: Delhi Court asks police to get sanction approval by Feb 6

A charge sheet filed by Delhi Police against Kanhaiya Kumar and nine others on January 14 is now facing a roadblock as the Delhi government is yet to give its sanction for prosecution. However, Delhi Court fixes the matter for February 6th. The court has asked Delhi Police to get required sanction approval by then.

JNU case: Delhi Court asks police to get approval from legal department

New Delhi: A charge sheet filed by Delhi Police against Kanhaiya Kumar and nine others on January 14 is now facing a roadblock as the Delhi government is yet to give its sanction for prosecution.

However, Delhi Court fixes the matter for February 6th. The court has asked Delhi Police to get required sanction approval by then.

On being questioned by the court, Delhi Police said that they will get sanction approval within 10 days.

According to the Criminal Procedure Code, in case of offences against the State (like waging war against the Government of India, sedition etc.), without the sanction from the home department, the court cannot take cognizance of the police’s charge sheet.

It is to be mentioned that Kanhaiya Kumar and nine others are alleged of organizing an ‘anti-national’ event at Jawaharlal Nehru University, Delhi in February 2016.
