Dayashankar moves plea in Lucknow HC; Seeks stay on his arrest

Lucknow: Expelled Bharatiya Janata Party (BJP) leader Dayashankar Singh on Tuesday has moved a petition in the Lucknow bench of the Allahabad High Court, seeking stay on his arrest. The hearing in the case will take place on July 28.

On Monday, the Chief Judicial Magistrate (CJM) court had issued a non bailable warrant (NBW) against Dayashankar who is absconding after an FIR was filed against him for making derogatory remarks against the Bahujan Samaj Party (BSP) Supremo Mayawati.

What is in the plea?

  • Police is acting over the FIR filed against him but he is not guilty under any sections
  • His arrest should be stayed till the investigation is under the process
