Central Govt quashes Amitabh’s suspension, informs the court

Lucknow: In a big jolt to Uttar Pradesh government, the Union Ministry of Home Affairs, in an affidavit in the court on Tuesday has submitted that Government of India had quashed IPS officer Amitabh Thakur’s suspension order issued by UP Government with effect from 11 October 2015.

The Central government stated this fact in the contempt petition filed against Union Home Secretary Rajiv Mehrishi filed in Lucknow bench of Allahabad High Court, which Amitabh had filed after extension of his suspension after the mandatory period of 90 days.

The Affidavit presented by Mukesh Sawhney, Under Secretary, MHA says as per section 3(8)(a) of All India Services Discipline and Appeal Rules, Amitabh’s suspension ended on 11 October because of not having been extended before 90 days, saying the State government has been directed by its letter dated 31 March 2016.

Presenting this Affidavit to the Home Department, Amitabh has sought issuance of formal order of reinstatement.
