SC holds Triple Talaq as 'unconstitutional'; directs govt to make law

New Delhi: In a historic judgement, the five-judge constitutional bench of the Supreme Court, on Tuesday, invalidated the historic Triple Talaq practice for six months and has asked the government to make a law regarding this.

The five-judge bench comprised of Chief Justice Jagdish Singh Khehar, Justice Kurian Joseph, Justice Rohinton Fali Nariman, Justice Uday Umesh Lalit and Justice S. Abdul Nazeer pronounced the historic verdict in favour of Muslim women.

Justice Nariman, Justice Umesh Lalit and Justice Kurien opposed the view of CJI Khehar and Justice Abdul Nazeer and termed the Triple Talaq practice as unconstitutional.

Meanwhile, the All India Muslim Personal Law Board (AIMPLB) has come out with a dissenting note on the verdict saying the judgement was subjected to further study.

Taking umbrage at triple talaq being declared as 'unconstitutional' Maulana Khalid Rashid,the member of AIMPLB said that ,''the triple talaq may have been held as unconstitutional but the same constitution has given us right to make and follow our own muslim personal law.'' Moreover. he said, the triple talaq verdict would be discussed at length in the general meeting of the AIMPLB on September 10 in Bhopal where the future course of action of the Board would also be ascertained.

Maulana Yasub Abbas, convenor and spokesperson All India Shia Personal Law Board, however, hailed the decision and said everyone should welcome it. ''Government should make a stringent law as it was made in case of sati abuse,'' Maulana Abbas said.

Shayara Bano (Triple Talaq Victim and Petitioner): It is a historic and independence day for Muslim women. Muslim fraternity should welcome the SC verdict and government should bring a law soon to permanently abolish the Triple Talaq practice.

Zafaryab Jilani (Member, AIMPLB): We have respected the Supreme Court's judgements in past. We will consider SC's verdict on Triple Talaq. Our grievances and apprehensions whether they have been addressed by the judges or not can be said after seeing the copy judgement.

Uttar Pradesh Chief Minister Yogi Adityanath: We welcome the Supreme Court's judgement of barring Triple Talaq. The historic verdict is complete justice to Muslim women.
