New Delhi: The Supreme Court issued a notice to the Election Commission of India seeking its opinion on disqualification of Bihar Chief Minister Nitish Kumar.
The notice has been issued, on Monday last, on a PIL filed by advocate ML Sharma on July 31, 2017 claiming that Nitish Kumar concealed his own criminal record in poll affidavits.
PIL further argued that Nitish Kumar misused his power to evade his arrest by occupying the constitutional post of the Chief Minister.
The division bench headed by Chief Justice of India Deepak Misra gave decision on his plea that had requested the court to initiate the investigation afresh.
It also demanded an order from the apex court to declare that people with a criminal case will not be eligible to contest the elections.

The police initially dropped the charges against Kumar, but they were levelled against him again in 2009. A villager Sitaram Singh had lost his life in clashes in 1991.
Recently after snapping ties with RJD, similar allegations were made by Laloo Yadav and his party men against Nitish.
