New Delhi: A resident of Bihar’s Siwan district on Friday filed a petition challenging the bail granted to former Rashtriya Janata Dal (RJD) Member of Parliament (MP) Mohammad Shahabuddin in the Supreme Court.

Chandrashekhar Prasad has accused Shahabuddin of murdering three of his sons. The petitioner’s lawyer, Prashant Bhushan, told the apex court that it was an inappropriate decision to release the dreaded criminal from jail taken by the HC.

“A ‘free and fair’ trial would simply not be possible with Shahabuddin being released on bail as the witnesses would never depose against the history-sheeter out of fear,” Prasad told the top court.

It may be recalled that Shahabuddin was granted bail by the Patna High Court on September 7 last in the 2014 murder case of Prasad’s son Rajiv Roshan. Subsequently, he was released from Bhagalpur jail on Saturday last.

Rajiv was a witness in the murder case of his brothers Satish and Gitish who were killed in an acid attack in 2004. Rajiv was murdered days before he was set to depose against the former RJD MP.

Furthermore, the apex court will hear the petition on Monday next.
