A son has no legal right on his parents acquired house: Delhi HC

New Delhi: The Delhi High Court on Monday said that a son can legally live in his parents home only at their "mercy".

The bench of Justice Pratibha Rani further added that just because a son keeps a cordial relation with his parents does not mean that they will have to bear his burden throughout their life.

Court's ruling came while dismissing an appeal by a man and his wife challenging the trial court's verdict in favour of his parents.

What is the matter?

- Parents of two sons moved the lower court, alleging that that their son and daughters-in-law have made their life a hell.

- They had filed a case with the police and issued public notices twice in 2007 and 2012, debarring them from their self-acquired property.

- Both the sons moved trial court and challenged that they co-won the property and had contributed towards its purchase and construction.

- Case went in favour of parents as both the sons failed to furnish enough evidences to claim their stand.

- One of the sons has now moved Delhi High Court to challenge the trial court's verdict.

What the Delhi HC said?

- A son, married or single, has no legal right to live in a house acquired by his parents. If he does, it will be only on parents mercy.
