No action against firms unable to pay full salary: Supreme Court

New Delhi: A hearing was held today in the Supreme Court on the matter of giving full salary to the employees during the lockdown. The Supreme Court today pronounced its verdict in the matter, stating that the employee and Company should settle the matter by mutual agreement. The state labor department will help in this.

We directed no coercive action to be taken against employers:

"It cannot be disputed that the industry and labourers need each other. Efforts should be made to sort out disputes regarding payment of wages for 50 days," a bench of Justices Ashok Bhushan, Sanjay Kishan Kaul and MR Shah said while passing the orders.

The Supreme Court gave its verdict on a number of petitions filed by several companies, including MSMEs, challenging the Home Ministry's order to pay full salaries and payments to employees during the 54-day period of lockdown.

Justice Bhushan says, 'We directed no coercive action to be taken against employers. Our earlier orders will continue. A detailed affidavit has to be filed by Centre in last week of July. Negotiation between employees and employers to be facilitated by State Government labour departments.'

Let us tell you that in the hearing held on June 4, the central government had said that it was necessary to issue an order to give full wages to the workers. The workers are economically in the weak condition of the society. It was taken care of without any difficulty in getting money without industrial activity. Now activities have been allowed. That order has been withdrawn from 17 May.
