Alld HC directs Ghaziabad DM to keep a check on encroachment

Allahabad: The Allahabad High Court on Monday directed the District Magistrate (DM) of Ghaziabad to take strict action against any encroachment of public land in Nehru Park.

Court said that if DM finds any encroachment then it must be removed expeditiously, and may take appropriate action in the this regard within three months.

The Bench comprising Chief Justice DB Bhosale and justice Yashwant Varma passed this order while disposing of a petition filed by one Shahnawaz Mansuri, a local resident.

Petitioner’s contention was that Nehru Park situated at ward no. 40, Adarsh Mandi, Prem Nagar, Loni of Ghaziabad is a Public park maintained by local authorities. However, few locals have illegally encroached the park land and are selling it to public, claiming that they are the real owners of these lands.

In the petition, temporary constructions raised over the land of Nehru Park was annexed to show the illegal encroachment of the park. Further, petitioner has also annexed advertisements published in a local newspaper offering land for sale to the public at large.

In the petition, few local land developers were made respondents and allegations of illegal encroachment were made against Vishal Sethi, Latif, Jahangir and Bhura who according to petitioner were illegally selling park land to public.
