This affidavit was filed by the chief secretary in a writ petition filed by Chandresh Kumar and seven others. Search committee was constituted by the government under the chairmanship of U P chief secretary for searching the names of chairman and three members of U P H E S C.

The court, therefore deferred the hearing of this case, fixing May 3, for the next hearing of this case.

It may be recalled that the high court by a judicial order had directed for the removal of chairman and its members on the ground that they had been appointed without having requisite qualification of the post. After this judicial order, the post of chairman and members were lying vacant and entire selection process was held up.
