HC dismisses petition to extend benefits to Loktantra Senani

Allahabad: A division bench of the Allahabad High Court on Monday dismissed a writ petition, demanding extension of benefit of Loktantra Senani to those who were sent to jail during JP moment in Uttar Pradesh.

The writ petition filed by Anil Kumar Singh and 13 others of district Deoria was dismissed by bench comprising of chief justice Dr DY Chandrachud and Justice Yashwant Varma, saying that the benefit of Loktantra Senani is given to those people who were sent to jail during emergency from June 25, 1975 to March 21, 1977. Admittedly all the petitioners were sent to jail during JP moment and were detained in jail from October 10, 1974 to November 11, 1974 and were not sent to jail during emergency period.

The Court said that since the Bihar government had extended the benefit of pension of Loktantra Senani to those also who were sent to jail in JP moment therefore the same benefit cannot be extended in UP as the state government has not given benefit to those who has sent to jail in JP moment prior to emergency.
