Alld HC quashes land acquisition proceedings in favour of Ansal

Allahabad: The Allahabad High Court on Wednesday quashed the land acquisition proceedings in favor of Ansal Properties Infrastructure Ltd in village Duda heda, Ghaziabad. The land was acquired by Ghaziabad Development Authority (GDA) for construction of residential colonies by Ansal group.

A two judges bench comprised of justice Arun Tandon and justice Sangeeta Chandra quashing the acquisition proceedings had observed that GDA has overlooked the government orders as well as the legal provisions in providing land to the private developers and the acquisition was made only to provide benefit to the company.

The order was passed allowing the writ petition filed by Smt. Devaki and several other land owners whose land.

In the writ petitions, the validity of the acquisition was challenged by saying that land can not be acquired in favor of private companies to construct residential colonies. The Court land was acquired in the year 2008.

It was submitted on behalf of state government that land was acquired for GDA which has given license to private companies for the construction of residential buildings which was not accepted by the Court. The Court was of the view that in fact land was acquired for benefits of private company and quashed the acquisition proceedings.
