Allahabad High Court Rejects Protection Plea for Married Muslim Woman and Hindu Live-in Partner

Allahabad: The Allahabad High Court on Friday asked the state government to produce a copy of the notification, whereby Eid-e-Mila/Barawafat holiday was deleted from the state holiday’s list.

The Court has fixed July 12, 2017 to produce the notification and Court will hear the case on the day itself.

A division bench comprising Chief Justice DB Bhosale and justice Yashwant Varma passed the above order while hearing petition filed by Basir Beg of district Bareilly.

In the petition, deletion of Barawafat holiday is challenged by the petitioner.

The petitioner's plea was that the holiday of Eid-e-Mila/Barawafat is a Public holiday declared by the central government under section 25 of the Negotiable Instrument Act. However, the state government can not delete it from the list of public holidays as it is provided in an Act passed by central government.

It might be recalled that Yogi government on April 25, 2017 issued notification whereby deleted about 15 holidays from the list including Eid-e-Mila/Barawafat.

The petitioner in petition is only concerned with Barawafat holiday and not other holidays.
