Allahabad: The Allahabad high court, in a major judgement, has ruled that son of a government employee whose father is also employed and still alive cannot be provided a job under the dependence quota.

Dismissing a petition in this regard the two-judge bench comprising justice Arun Tandon and justice Sunita Agrawal said on Tuesday since his father continues to be in a government job providing government employment to him on mother’s death will go against the spirit of law in this connection.

The petitioner had moved the division bench after his plea was rejected by the single judge bench. Single or a divorced woman provides a natural protection to the child. In case of her death father becomes his natural guardian. As such, he or she is not entirely dependent on the government for a livelihood in case of either of the two parents.

The government department where she was working had also rejected his plea.
