SC refers triple talaq case to Constitution bench, hearing on May 11

New Delhi: The Supreme Court on Thursday transferred the 'triple talaq' case to the constitution bench which will begin hearing the petitions lodged against the Islamic divorce procedure, considered to be biased against women, from May 11.

The court will hear all the pleas filed by Muslim women challenging the Islamic practice under which they can divorce their wives instantly by speaking the word 'talaq' thrice.

Muslim women have been challenging the triple talaq procedure over the years, and finally the government has said it wants to replace it with a new uniform civil code which will be applicable to the people belonging to every religion.

The proposal, however, is facing stern opposition from Muslim groups, who are saying that the decision would discriminate against them.

Prime Minister Narendra Modi had also taken a dig into the matter saying that the triple talaq reform was the need of the hour to uphold the rights of Muslim women of the country.

Every religion in the country has a different set of personal laws for marriage, divorce, succession, adoption and maintenance. The Hindu laws, however, started to be overhauled since 1950s, but the activists have claimed that the Muslim personal laws have remained mostly unchanged.
