No law to stop Centre from presenting budget early, rules SC

New Delhi: There is no such provision in law that can restrict the Centre from advancing the date of presentation of the annual budget, stated the Supreme Court on Friday reacting on a petition.

The apex court also asked the petitioner, advocate ML Sharma, to tell the court if there was any such law that could back his plea against the central government's decision.

The SC bench, comprising Chief Justice Jagdish Singh Khehar and Justice DY Chandrachud, said, "We tried to find the provision but we did not get."

The bench also asked Sharma to show which provision of the law or the constitution the government had violated advancing the date of presentation of budget to February 1.

The court gave Sharma time till January 20 to find out the provision to back his plea in which he has appealed the court to defer the budget till the last phase of elections in five states is over.

The Centre has advanced the presentation of annual budget to February 1. Earlier, the presentation used to be done on the last day of February.
