Chennai HC rejects petition challenging Jayalalithaa’s election

Chennai: The Chennai High Court on Friday rejected a petition challenging the election of Tamil Nadu Chief Minister Jayalalithaa from the R K Nagar assembly constituency of the city in a by-election held last year.

The petition was filed by T Suresh, an independent candidate. Suresh, in his petition, challenged the Anna Dravida Munnetra Kazhagam (ADMK) chief’s election in the by-poll held on June 27, 2015 contending that the returning officer had rejected the papers of his nomination on false grounds. The petitioner had sought the rejection of his nomination papers to be declared as ‘illicit’ and the Jayalalithaa’s election as ‘void’.

It may be mentioned that the nomination papers of Suresh were rejected because one of his proposers’ name was not found in the electoral rolls.

“Once the election is declared and electoral rolls are published, it does not remain open to challenge on the ground that the rolls were defective,” said Justice Pushpa Sathyanarayanan while rejecting the petition.
