New Delhi: Clarifying on its earlier order, the information and broadcasting ministry on Thursday said that the bar on airing of condom ads on TV during the daytime was only applicable for those having sexually explicit content.

The clarification has come after the Rajasthan High Court on Wednesday issues a notice to the Centre wanting to know the reason behind the December 11 advisory to TV channels to ban the airing of condom advertisements between 6 am and 10 pm.

The advisory had been issued citing that condom ads could be indecent/inappropriate for viewing by children.

An NGO had challenged the decision in the Rajasthan High Court.

In Wednesday's memorandum, the ministry cited a rule under the Programme and Advertising Code of Cable Television Network Rules, 1994 which restricts airing of any programme in the cable service that contains anything obscene, defamatory, deliberate, false and suggestive innuendos and half-truths.

It also mentioned another rule that prohibits all advertisements which project women in the bad light.
